Non Molestation Order: Tracing, Surveillance & Personal Service
The Challenge
Europa Investigations received an urgent instruction from solicitors to serve Non-Molestation Order on a respondent believed to be residing at an address in Dorset.
The matter had an imminent response deadline. The initial instruction appeared straightforward. However, the respondent was not found at the instructed address, requiring the matter to adapt quickly.
First Attendance & Local Enquiries
An evening attendance on the same day was made at the instructed address but the respondent was not present. Rather than simply recording it as a failed attempt, the investigator conducted discreet enquiries with neighbouring properties. The information obtained indicated that the respondent did not reside at the property full time and only attended occasionally. Further information subsequently indicated that the respondent may have travelled to a holiday park located 46 miles away from the original address.
Developing the Instruction
The solicitor authorized an attendance at the holiday park. The location presented a significant challenge as the park contained hundreds of caravans and the respondent's exact accommodation was unknown.
Additional identifying information was obtained, including details of a vehicle believed to have been used by the respondent. However, only a partial registration was available. The investigator assessed the available information and developed a targeted approach rather than conducting an indiscriminate search of the site.
Vehicle Identification & Static Covert Surveillance
During the attendance at the holiday park, a vehicle believed to correspond with the information provided was identified. Rather than immediately approaching the associated pitch, the investigator observed the location from a suitable distance using covert surveillance.
The purpose of the surveillance was to establish whether the respondent was actually present before attempting service. Observation of the pitch and surrounding activity subsequently provided confirmation that the respondent was present at the location. This allowed the investigator to proceed with the service attempt on the basis of verified information rather than relying solely on the partial vehicle registration.
Additional Digital Tracing
As an additional investigative measure, digital tracing was conducted using specialized credit intelligence database. The search produced further information concerning the respondent's current residential address and an active telephone number. This created an additional contingency for a further service attempt if the respondent could not be located at the holiday park.
Successful Personal Service
Following confirmation of the respondent's presence, the investigator proceeded to make contact. The respondent was successfully located and personally served. Photographic evidence of the respondent's vehicle was obtained before and after service to support the attendance record. A completed and signed proof of service was subsequently provided to the instructing solicitor.
Outcome
Successful personal service was achieved before the court deadline. What began as an urgent residential service instruction developed into a multi stage field investigation when the respondent could not be located at the original address.
Why This Approach Mattered
The investigation demonstrates the advantage of combining process serving, digital tracing and investigative fieldwork.
Rather than repeatedly attending an uncertain address, the investigator assessed new information as it emerged, identified alternative leads and used surveillance to verify the respondent's presence before proceeding.
This approach can be particularly valuable in urgent proceedings where a respondent is difficult to locate, does not anymore reside at the instructed address or may be temporarily staying elsewhere.
